Terms of service

nekoHaru (the "Service") is a Discord bot operated by HarutoStudio ("we"), and its associated website harutoo.com and control panel app.harutoo.com.

These terms are available in multiple languages. If there is any inconsistency between language versions, the English version prevails.

This service is specially designed for Discord servers (guilds). Any Discord user can use related functions in servers that have joined this service. By adding a robot to the server, using its functions, or logging into the control panel, you agree to these Terms of Service.

When using this service, you must comply with the following regulations:

• You may not use any feature of the Service to engage in illegal, offensive or infringing conduct.
• You may not use this service to participate in or promote illegal or inappropriate activities such as pornography, gambling, exploitation of minors, harassment of others, etc.
• You may not abuse the functionality of the Service to harass other users or disrupt the normal operation of the server.
• You are responsible for your own actions and understand that violating these standards may result in suspension or termination of service.

You may not use any third party, automated tools or malicious programs, or exploit system vulnerabilities to interfere with, destroy, circumvent or affect the normal operation of the Service. If the above behavior causes service interruption, data anomalies, losses to other users or other damages, we reserve the right to suspend or terminate services, restrict the use of functions, and pursue relevant responsibilities and seek compensation in accordance with the law.

The basic functions of this service are permanently provided free of charge. A Premium subscription plan is also available to increase the usage limit of some features and additional services. The plan content and price are subject to the announcement on the Premium page.

• Subscription and Renewal: Premium is a monthly or annual subscription service. Unless you cancel before the end of the current period, the subscription will automatically renew and be charged for the same period at the end of each period.
• Unsubscribe: You can unsubscribe at any time. After cancellation, the subscription will not be renewed and the paid benefits for the current period will be retained until the end of the period.
• Plan application: Premium benefits are bound to the purchaser's Discord account and applied to the specified server according to the plan instructions. If the purchaser loses the administrative rights of the server, or the robot is removed from the server, the server-side rights will not take effect, but you can apply them to other servers instead.
• Price changes: We may adjust plan prices. The adjustment will take effect in your next billing cycle and will be notified in advance via the website or email before it takes effect; you can cancel your subscription before it takes effect.
• Refunds: Please see Refund Policy for refund regulations.

Online orders for this service are processed by Paddle.com in its capacity as Merchant of Record. Paddle is responsible for collecting payments, issuing receipts, and collecting and remitting relevant taxes and fees in accordance with local regulations. Paddle also assists in handling customer service and refund operations during payment.

When making payment, you also apply the Paddle Buyer Terms. The Service does not obtain or store your complete credit card or payment account information.

If you need to delete the content or settings you created, you can remove it yourself in the control panel, or contact the official community and customer service mailbox. We will process your request.

This service will process relevant data in accordance with the Privacy Terms for the purpose of providing services, security protection, maintaining system stability and improving user experience.

We may add, modify, restrict, suspend or terminate some functions or service content due to functional updates, security, legal requirements, maintenance or other operational needs, and adjust function settings or usage methods as appropriate.

If the change has a substantial adverse impact on the main rights and interests of Premium subscribers, we will announce it in advance; subscribers can cancel their subscriptions and apply for a refund of the unused period in accordance with the Refund Policy.

If you violate these terms of service, abuse the service, affect service security, endanger the rights and interests of other users, or have other major reasons, we may limit, suspend or terminate your permission to use some or all functions at our reasonable discretion. Paid rights terminated due to the above reasons will be handled in accordance with the refund policy and relevant laws.

The Service is provided on an "as is" and "as available" basis. We will try our best to maintain the stability and accuracy of the service, but we do not guarantee that the service will be uninterrupted or error-free, or that all fraud and malicious content can be detected. This service relies on third-party platforms such as Discord, YouTube, and Twitch. The impact of abnormalities or policy changes on these platforms is beyond our control.

To the extent permitted by law, we are not liable for indirect damages arising from the use or inability to use this service; if we are legally liable, the total amount shall be capped at the amount you actually paid for this service within the twelve months before the event occurred.

These Terms of Service shall be governed by the laws of the Republic of China (Taiwan). In the event of a dispute, both parties agree that the Taipei District Court of Taiwan shall be the court of first instance. However, if the law has other mandatory provisions, such provisions shall prevail.
